摘 要 :针对网络游戏的纠纷频繁出现,盗窃网络虚拟财产的行为也日益猖獗。由于刑法理论和司法观念的滞后,相应法律法规的欠缺,使得受害者得不到及时法律救济。司法实务界针对这一行为的定性问题呈现出不同的观点,实践中针对已发生的盗窃网络虚拟财产案件作出不同的刑事处罚,这显然不利于我国刑罚的统一性,我国刑事司法在遵循罪刑法定原则的前提下,应当进一步协调刑法确定性与适应性之间的矛盾。本文针对这一问题,从网络游戏虚拟财产的概念界定入手,阐述了网络虚拟财产的特征,法律性质,并对网络虚拟财产是否具有财产价值属性进行论证。阐明网络虚拟财产是目前现实生活中,不可忽视的一种新型财产;网络虚拟财产具有现实经济价值和可支配的动产属性,可作为盗窃罪的犯罪对象;结合虚拟财产盗窃的现状,提出将网络游戏虚拟财产盗窃罪吸纳进现行刑法,并通过相关法律解释完善我国相关法律的观点。主要研究盗窃网络游戏虚拟财行为的定性与犯罪构成问题,以及确立网络虚拟财产盗窃罪的必要性、难点与解决方法。主张确定网络游戏虚拟财产盗窃罪,希图从刑法角度对公民网络游戏中的财产权予以终极保护。同时,比较国外及研究在此领域比较发达的韩国、我国台湾地区的立法与司法实践,以期通过借鉴,完善我国的相关立法,更好地保护网络安全与公民权益。

前 言
自2000来游戏产业的迅速发展,已经成为一个新兴产业。2007年我国网络游戏市场规模达到67亿元。网络游戏的不断兴起,不仅仅是发展了游戏本身,而且其内部的虚拟武器、设备甚至游戏快感都变成了可以流通的商品,滋生着利润,出现了买家和卖家,甚至产生了市场。并且其对IT行业(包括PC、在线游戏服务器、网络设备、存储产品、游戏软件和SP)也有着直接而重大的贡献。网络游戏带动的相关产业的发展犹如一颗大树的根系伸向了四面八方。但在高速发展的同时,一些不法之徒将黑手伸向这片领地。他们利用技术手段,侵入计算机系统,盗窃玩家的虚拟财产,销赃牟利,给玩家带来了经济损失和精神痛苦。网络虚拟财产大约有76%的玩家有被窃经历。但由于我国在保护虚拟财产法律属性方面看法不一,盗窃网络虚拟财产的行为也未被法律列为盗窃罪,致使受害者投诉无门,有的玩家被窃后甚至以其人之道还其人之身,有的则自认倒霉。这破坏了游戏产业的发展,还影响到社会治安问题。引发一个新的法律问题----盗窃网络虚拟财产是否构成刑法意义上的盗窃罪。
