电子商务带来的法律问题探究
[摘 要] 每一次科技革命都将对人们原有的生活方式、工作方式、思维方式带来猛烈的冲击，从而产生更为深层的社会变革和发展。90年代以来，计算机网络飞速发展，人类社会信息化时代步伐加快，各国各地区间的经济往来不断融合、频繁，世界经济趋于全球化。伴随着新经济形势和互联网络的兴起繁荣，国家分工不断向广度和深度发展，电子商务的出现改变了传统经济运行的模式，也给整个生产方式和经济带来了巨大冲击和空前的发展机遇与挑战。因此，电子商务不仅要具备一般交易的基本特征，还涉及到许多特殊问题。基于新形势和新问题的不断出现，相对国内外这一领域的立法还很不健全的现状，笔者试用粗浅的笔触对电子商务带来的法律问题作些粗简的分析和探讨。

[Summary] Each technological revolution not only brings people new life-style, changes the way people think and work, but also makes differences in society. From 1990, as the economic globalization developing, computer network was booming and the steps toward the era of information was hastened. Under such circumstances, EC(Electronic commerce) emerged, and changed the traditional patterns of economic. Without the limits of time and space, EC changed the means of trade, the modes of production and brought greater opportunities and challenges to economy. Under this brand-new pattern of business, EC is not only characterized by normal trade, but also involved with some special legal issues.Based on status quo that situation keeps changing and new problems keeps emerging, plus the legislation of EC is inadequate in china, here, we will analyze and probe the legal issues about EC.
